Terms & Conditions
All quotations are made and orders accepted subject to the following Conditions of Sale. Buckford Illumination Group, (The Company) will not accept any other terms and conditions other than those specified nor any other addition or variation thereto.
The Company does not provide any separate warranty on products. Buckford Illumination supports the manufacturers’ stated warranty and reserves the right to action a warranty claim until the relevant manufacturer has acknowledged that the incidence constitutes a valid warranty claim. Under no circumstances can the Company accept liability for labour charges, out of pocket expenses or damage incurred by defects however caused.
All prices quoted are exclusive of GST. Whilst every endeavour will be made to invoice goods at the prices quoted and/or acknowledged that the Company reserves the right to invoice at prices ruling at time of despatch.
The Company endeavours to quote the correct quantities specified. It is the responsibility of the client or contractor to verify quantities against drawings and final specification.
Settlement of approved Distributor accounts is required within the period agreed to on the credit agreement. Goods remain the property of the Company until payment has been made, the risk of goods remains that of the client after goods have been despatched. The Company shall have the right to stop at any time delivery and the discretion to determine any contract if the client defaults on payment of any order after it has become due for payment.
Any times quoted for despatch are given and intended as estimates only and the Company shall not be liable for any loss for failure to deliver or despatch within these times. The customer shall undertake to ensure the disposal of the products supplied. In case of a resale, the customer shall pass this obligation on to its buyer.
Carriage is free into store Melbourne metro areas. Unless otherwise stated deliveries outside Melbourne metro areas will be the sole responsibility of the client.
8. Loss or Damage in Transit
Unless goods have been checked on receipt they should be signed for "Unexamined". Claims for shortage or damage in transit must be notified in writing to the carrier and ourselves within three days of receipt and in case of non-delivery within 10 days of date of advice.
9. Cancellations and Returns
The written consent of the Company must be obtained before cancellation of any order is accepted. The Company reserves the right to charge for costs involved in accepting the cancellation. Goods may not be returned without the Company's written consent and without the Company's return form. Where permission for the return of goods is given a handling charge plus any carriage charge involved will be made. Goods should be returned carriage paid to our warehouse in good resaleable condition with its original packing. Special fittings manufactured to a special non standard design cannot be cancelled when production has started and cannot be returned.
Goods purchased for the Australian market must not be offered for export without the Company's previous written consent.
11. Trade Description
All reasonable precautions have been taken to ensure that the descriptions, illustrations and technical data in our manufacturers’ catalogues are correct at the time of printing. As the Company's products are subject to improvements and modification all information is intended as guidance only. Colour finishes will be maintained as accurately as possible.
All trade works drawings, descriptions and other information issued by the Company remain the property of the Company together with the copyright and patents therein.
The manufacturers’ warranty claim expires for the products that have been changed, modified or amended etc. by third parties (outsiders), i.e. if they are no longer in the original condition they were in when they left the warehouse.
Buckford Illumination Group is not responsible for any delays that arise due to unforseen events such as transport delays, accidents, stock shortage, strikes, or any other event that is deemed to be beyond our control.
NCNR – Non-Cancellable, Non-Returnable.
Any ‘made to order’ luminaire, accessory or lighting pole/ bracket that is made or adapted to specifically meet with a project requirement or is powder coated a special colour will be deemed to be an NCNR item. A NCNR item cannot be cancelled or returned. This forms part of our terms and condition of sale and constitutes a binding agreement between purchaser and Buckford Illuminations Group. Under special circumstances Buckford Illuminations Group may agree to the cancellation or return of goods, however a re-stocking fee will apply and the percentage will be at the discretion of Buckford Illumination Group.
